Complete Guide to UK Capital Gains Tax (CGT)
1. The Autumn Budget 2024 CGT Overhaul
In the Autumn Budget on 30 October 2024, the UK Government raised the main CGT rates:
- Basic Rate: Increased from 10% to 18% on shares, crypto, and other assets.
- Higher Rate: Increased from 20% to 24% on shares, crypto, and other assets.
- Residential Property: Maintained at 18% (basic) and 24% (higher).
2. Annual Tax-Free Allowance (£3,000)
Every individual in the UK is entitled to an Annual Exempt Amount (AEA) of £3,000. This allowance is "use it or lose it" and cannot be carried forward to future tax years. Spouses or civil partners can transfer assets prior to sale to utilize both allowances, achieving up to £6,000 tax-free.
3. Business Asset Disposal Relief (BADR)
Qualifying business directors and sole traders selling all or part of their business can benefit from BADR, keeping CGT at 10% up to a lifetime cap of £1,000,000. Under current legislation, BADR will increase to 14% from 6 April 2025 and 18% from 6 April 2026.
4. Allowable Deduction Rules
You can lawfully deduct:
- Legal fees, Stamp Duty (SDLT), and survey fees paid when acquiring the asset.
- Capital enhancement expenditure (e.g. building an extension or installing central heating; routine repairs and decorating do not qualify).
- Incidental selling fees (estate agency commission, advertising, legal conveyancing).
