Australian Stamp Duty & First Home Buyer Regulations Explained
What is Stamp Duty in Australia?
Stamp duty (also legally designated as transfer duty) is an ad valorem state and territory tax levied by State Revenue Offices on the transfer of real property. Because real estate taxes are state-controlled under the Australian Constitution, duty brackets, concession thresholds, and foreign purchaser surcharges differ significantly between New South Wales, Victoria, Queensland, Western Australia, South Australia, Tasmania, the ACT, and the Northern Territory.
Stamp duty is payable either at property settlement or within 30 to 90 days of contract exchange depending on the state, and cannot be added onto your standard home loan unless you have sufficient borrowing power and equity.

Frequently Asked Questions
When must stamp duty be paid to the State Revenue Office? +
In most Australian states (like VIC, QLD, WA, and SA), stamp duty is payable directly at property settlement through PEXA electronic conveyancing. In NSW, duty is technically due within 3 months of contract signing or at settlement (whichever comes first). For off-the-plan owner-occupier purchases in NSW, payment can often be deferred for up to 12 months.
What is the Foreign Purchaser Additional Duty (FPAD / AFAD)? +
Foreign citizens purchasing residential real estate in Australia are subject to an additional stamp duty surcharge on top of standard transfer duty. This rate is currently 8.0% in NSW, Victoria, Queensland, Tasmania, and the ACT, and 7.0% in Western Australia and South Australia. Australian citizens and permanent residents who meet the 200-day residency test are exempt.
